LAT and TARION September 15, 2007 3:54 PM
Why does the LAT's Licence Appeal Tribunal process to fight TARION'S decisions from their engineers and inspectors so biased towards the builders as the statistics show? Why is it that only recourse from a devil may care builder is to hire a lawyer" And a badly served homebuyer cannot afford both. Go to the Canadian for Properly Built Homes and see for yourself. New homebuyers must have more input and control over a lifetime purchase. Now is the time to act with elections coming up. Push to have TARION put under the jurisdiction of the OMBUDSMAN as was the case for MPAC, the organization assessing homes for taxe purposes and the ONTARIO LOTTERY.
Two white elephants that we were told were untouchable. The Ombudsman's Office has been advocating extending its jurisdiction since 1986. They know there are problems in TARION.

And why do they, at the pre-hearing, declare that most of the big issues ARE NOT IN THEIR MANDATE... It seems that they are the final say as to what is within their mandate!!! Lawyer's advice: Don't waste your money ($10-12K) on the LAT... Save it for court costs!

There's an election going on in Ontario. Go to your politicians and ask them what is their platform on what warranty can new homebuyers depend on when they buy a new home. TARION is obviously not the answer. We want TARION governed by the Ombudsman so that we can have an unbiased voice. May I suggest that you ask your candidates in your riding, the Liberals and the Conservatives, the NDP is already committed to our cause, if they will help to get their party to officially confirm their position on this issue on the site of CPBH, www.canadiansforproperlybuilthomes.com . CPBH will then send a Newsletter to all its members showing that Party's position. This is a great site. You will find all kind of information.
The courts sadly is our only means at the moment to get redress right now. This has to change because we know after buying a house there is very little left to pay lawyers. Therefore, bad builders get away with murder. Only the Ontario Ombudsman can stop this.
